07

Penalties and Mistakes

What operating without registration costs, plus the common errors, from wrong thresholds to weak address proof, that get applications rejected or delayed.

Why This Matters

GST Registration Is Simple, Until You Get It Wrong

You know your business needs a GSTIN. So you open gst.gov.in, start the form, and 20 minutes in you are stuck: which address proof is valid, do you need a DSC, and does your rent agreement count?

This is where most first-time applicants lose days. Not because the process is hard, but because they start without the right documents ready and pick the wrong answers along the way.

The threshold trips people up first. A trader thinks the Rs 40 lakh limit protects them, forgetting that the moment they add any taxable service, the limit drops to Rs 20 lakh. Others miss that selling on Amazon, Flipkart, Zomato, or Swiggy needs registration from the first rupee, no matter the turnover. Restaurants in particular should read up on GST rates and rules for restaurants before they register.

Then comes the paperwork. A rent agreement without the owner's electricity bill, an outdated utility bill, or a legal name that does not match the PAN character for character. Any one of these triggers a clarification notice in FORM GST REG-03 and pushes your approval back by a week or more.

Getting it wrong is not just slow, it is expensive. Operate while liable but unregistered and the penalty is Rs 10,000 or the tax evaded, whichever is higher, under Section 122 of the CGST Act, administered by CBIC. On top of that you owe the tax plus interest, and you cannot claim input tax credit for the period you stayed unregistered.

This checklist removes the guesswork. It tells you whether you must register, lists the exact documents for your business type, walks through the online steps, and flags the mistakes that get applications rejected. Get it right the first time, and most eligible businesses now get approved in 3 to 7 working days.

What the checklist shows for a proprietorship

Here's a preview of what you'll get inside:

PAN and Aadhaar of the proprietor: the proprietor's own PAN is the business PAN, there is no separate entity PAN
Photograph: recent passport-size colour photo in JPEG (up to 100 KB)
Address proof (any one): latest electricity bill or property tax receipt if owned, or rent agreement plus owner's electricity bill if rented
Bank proof: cancelled cheque, passbook first page, or statement can be added within 30 days of registration under Rule 10A
Authentication: Aadhaar OTP (EVC) is enough for a proprietorship, no DSC needed, unlike companies and LLPs
... plus the full document list for partnership, LLP, company, HUF, and trust, the step-by-step process, timelines, and penalties across 7 sections.

Common Mistakes

6 GST Registration Mistakes Indian Businesses Make

01

Assuming the Rs 40 lakh limit when you also supply services

The higher Rs 40 lakh threshold applies only to businesses dealing exclusively in goods. Add any taxable service and the limit drops to Rs 20 lakh. Assume the wrong one and you register late, and pay a penalty.

02

Ignoring compulsory registration under Section 24

Inter-state sale of goods and selling through e-commerce operators need registration from the first rupee, regardless of turnover. Many online sellers and cloud kitchens miss this and operate illegally.

03

Weak or mismatched address proof

A rent agreement without the owner's ownership proof, or an outdated electricity bill, is the top reason for a REG-03 notice. The address on every uploaded document must agree.

04

Legal name not matching PAN exactly

The legal name in Part A of REG-01 must match the PAN database character for character. Even a small mismatch fails validation and stalls the application before it starts.

05

Skipping Aadhaar authentication

Declining Aadhaar authentication drops you into the 30-day physical verification track. Authenticate Aadhaar and you stay in the 3 to 7 working day lane instead.

06

Missing the REG-03 reply window

If the officer raises a clarification notice, you get only 7 working days to reply through FORM GST REG-04. Miss it and the application is rejected, and you start over.

FAQ

Frequently asked questions

Who needs to register for GST in India?
You must register if your aggregate turnover crosses Rs 40 lakh for goods or Rs 20 lakh for services in normal states (Rs 20 lakh and Rs 10 lakh in special-category states). You must also register regardless of turnover if you fall under Section 24 of the CGST Act, which covers inter-state supply of goods, selling through e-commerce operators like Amazon, Flipkart, Zomato, or Swiggy, casual taxable persons, reverse charge cases, and more. The full GST compliance journey begins the day your GSTIN is active.
What documents are required for GST registration?
Every application needs a PAN, Aadhaar, a photograph, proof of the principal place of business, and bank account proof. The rest depends on your entity type. A proprietorship uses the proprietor's PAN and can authenticate with Aadhaar OTP. A partnership needs the partnership deed and all partners' details. Companies and LLPs need a Certificate of Incorporation, a board resolution, and a Class 3 Digital Signature Certificate (DSC), which is mandatory for them. Valid address proof includes a latest electricity bill, property tax receipt, rent agreement with the owner's proof, or a consent letter for shared premises.
How long does GST registration take?
Low-risk applicants under the new simplified scheme (Rule 9A) get automated approval in 3 working days. Standard applications where Aadhaar is authenticated and no risk flag applies are approved within 7 working days. If you do not opt for Aadhaar authentication, or your application is flagged for physical verification of premises, it can take up to 30 days. If the officer takes no action within the window, registration is deemed granted automatically.
Is there a fee for GST registration?
No. GST registration is completely free on the official portal at gst.gov.in. The government charges nothing. You only pay if you choose to hire a chartered accountant or consultant to file the application on your behalf. Since there is no fee and the process is online, there is no reason to delay registration once you are liable. You can even check GST amounts using a free GST calculator before you start billing.
What happens if I don't register for GST when I should?
Operating without registration when you are liable attracts a penalty of Rs 10,000 or the amount of tax evaded, whichever is higher, under Section 122(1) of the CGST Act. On top of the penalty, you must pay the GST that should have been collected during the unregistered period, along with interest under Section 50, and you cannot claim input tax credit for that period. Repeated non-compliance can also lead to further action. Once registered, keep your GST invoices compliant from invoice number one.
