Why This Matters

Payroll Penalties Don't Wait for Indian Businesses to Catch Up

Here's the reality for most Indian SMEs. Payroll compliance runs on spreadsheets. Someone manually tallies attendance, applies PF and ESI formulas they copied from a blog post two years ago, and hopes they file everything on time. Miss one deadline and the penalties kick in automatically. No warnings, no grace period.

TDS on salary must be deposited by the 7th of the following month. Late by even a day? Interest at 1.5% per month on the amount, plus a flat ₹200/day late filing fee under Section 234E. PF contributions are due by the 15th. Late payment triggers interest under Section 7Q of the EPF Act, plus damages that can go up to 25% under Section 14B. ESI challans, also due by the 15th, attract 12% per annum interest when paid late.

What makes Indian payroll tricky isn't any single deduction. It's that different deductions use different wage bases. PF is calculated on basic + DA only. ESI applies to gross wages. Professional Tax uses gross income slabs that vary by state. Mix up the wage base for even one deduction and you've got an incorrect payroll. Multiply that across 50 or 100 employees, and you're looking at EPFO scrutiny or an ESI audit.

Multi-state operations make it worse. Professional Tax slabs are completely different in Maharashtra, Karnataka, West Bengal, and Tamil Nadu. LWF rates and deadlines vary too. If you have employees in three states, you're running three separate PT calculations every month.

A checklist won't replace payroll software. But it does something software alone can't: it forces you to verify inputs before the payroll run, confirm statutory payments after, and reconcile everything at month-end. Calculating PF on gross salary instead of basic+DA

Not pro-rating salary for mid-month joiners and exits

Using the same wage base for PF and ESI

PF = basic + DA. ESI = gross wages. Two different calculations, two different bases. A surprising number of businesses get this wrong.
