What is Maternity Leave in India?

Maternity leave in India is a legal right granted to working women under the Maternity Benefit Act, 1961. The Act was significantly amended in 2017 to increase the leave period from 12 weeks to 26 weeks for the first and second child, making India one of the most progressive countries in terms of maternity benefits.

The Maternity Benefit (Amendment) Act 2017 applies to all establishments employing 10 or more people, including factories, mines, plantations, shops, and offices. The Act ensures that a woman receives her full salary during the leave period, calculated based on the average daily wage.

  • Women are entitled to 26 weeks of paid maternity leave for the first and second child, with up to 8 weeks available before the expected delivery date
  • For the third child onwards, the entitlement reduces to 12 weeks of paid leave
  • Adoptive mothers (child under 3 months) and commissioning mothers (surrogacy) are entitled to 12 weeks of leave from the date the child is handed over
  • The employee must have worked for at least 80 days in the 12 months immediately before the expected delivery date to qualify. Use our work hours calculator to verify total days worked

How to Calculate Maternity Leave Benefit

The maternity benefit is calculated based on the average daily wage and the total number of leave days the employee is entitled to. The daily wage is derived by dividing the monthly gross salary by 26 working days (as per standard payroll convention in India).

Total Benefit = (Monthly Salary / 26) x Leave Days

The formula uses 26 as the divisor because Indian payroll standards count 26 working days per month (excluding Sundays). This is the same method used by the labour department for calculating wages under the Payment of Wages Act.

Daily Wage: Monthly Gross Salary / 26

Normal Delivery (1st/2nd child): Daily Wage x 182 days (26 weeks)

Normal Delivery (3rd+ child): Daily Wage x 84 days (12 weeks)

Adoption / Surrogacy: Daily Wage x 84 days (12 weeks)

Miscarriage / MTP: Daily Wage x 42 days (6 weeks)

Tubectomy: Daily Wage x 14 days (2 weeks)

Maternity Leave Calculation with Example

Let's calculate the maternity benefit for a woman earning ₹50,000 per month who is expecting her first child.

Monthly Gross Salary: ₹50,000

Daily Wage: ₹50,000 / 26 = ₹1,923.08

Leave Duration: 26 weeks = 182 days (first child)

Total Maternity Benefit: ₹1,923.08 x 182 = ₹3,50,000

Pre-delivery Leave: Up to 8 weeks (56 days) before the expected delivery date

Post-delivery Leave: Remaining 18 weeks (126 days) after delivery

In this example, the woman would receive ₹3,50,000 as the total maternity benefit for the 26-week leave period. The employer must pay this amount during the leave, and it cannot be reduced or delayed. If the same woman were expecting her third child, the benefit would be ₹1,923.08 x 84 = ₹1,61,538.

Maternity Leave Entitlement by Type

The duration of maternity leave varies based on the type of event and the number of surviving children. Here is a complete breakup of leave entitlement under the Maternity Benefit Act 2017:

Type Leave Duration Pre-delivery Leave
Normal Delivery (1st or 2nd child) 26 weeks (182 days) Up to 8 weeks
Normal Delivery (3rd child onwards) 12 weeks (84 days) Up to 6 weeks
Adoption (child under 3 months) 12 weeks (84 days) From date of handover
Surrogacy (Commissioning mother) 12 weeks (84 days) From date of handover
Miscarriage / Medical Termination 6 weeks (42 days) From date of event
Tubectomy Operation 2 weeks (14 days) From date of operation

All the above entitlements are for paid leave. The employer must pay the full average daily wage for the entire duration. The leave period includes Sundays and holidays that fall within the leave period.

Key Provisions of the Maternity Benefit Act

The Maternity Benefit (Amendment) Act 2017 introduced several important provisions beyond just leave duration. Here are the key protections and benefits every employer and employee should know:

  • Work from Home: After the maternity leave period, the employer may allow work from home if the nature of work permits. This is at the discretion of the employer and must be mutually agreed upon
  • Creche Facility: Establishments with 50 or more employees must provide a creche facility within a prescribed distance. The woman is allowed four visits to the creche daily, including rest intervals
  • No Termination: An employer cannot dismiss, discharge, or reduce the conditions of service of a woman during pregnancy, maternity leave, or immediately after returning from leave. Doing so is a criminal offence
  • Medical Bonus: A medical bonus of ₹3,500 is payable if the employer does not provide free pre-natal and post-natal care. This is in addition to the salary benefit
  • No Hazardous Work: A pregnant woman cannot be required to do work that is arduous, requires long hours of standing, or is likely to adversely affect her health during the 10 weeks before the expected delivery
  • Nursing Breaks: After returning from maternity leave, a woman is entitled to two nursing breaks of 15 minutes each until the child reaches 15 months of age

Under the Maternity Benefit (Amendment) Act 2017, women are entitled to 26 weeks (182 days) of paid maternity leave for the first and second child. For the third child onwards, the entitlement is 12 weeks (84 days). Adoptive and commissioning mothers get 12 weeks from the date the child is handed over. In case of miscarriage or MTP, 6 weeks of leave is allowed, and tubectomy operations qualify for 2 weeks of leave.
Is maternity leave paid in India?
Yes, maternity leave is fully paid in India. The employer must pay the employee at the rate of the average daily wage for the period of actual absence. The daily wage is calculated by dividing the monthly gross salary by 26 working days. Use our in-hand salary calculator to check your take-home pay. The entire maternity benefit amount is paid by the employer, and no deductions are made from the employee's salary during this period.
Who is eligible for maternity leave in India?
To be eligible for maternity benefit, a woman must have worked for at least 80 days in the 12 months immediately preceding the expected delivery date. The establishment must employ 10 or more employees. This applies to all women employed in factories, mines, plantations, shops, and establishments. Contract workers and daily wage workers are also covered if they meet the 80-day requirement.
What is the maternity leave entitlement for the third child?
For the third child and beyond, a woman is entitled to 12 weeks (84 days) of paid maternity leave. This is significantly less than the 26 weeks allowed for the first and second child. The 12-week period can be taken up to 6 weeks before the expected delivery date. All other benefits such as the medical bonus and protection from termination still apply.
Is maternity leave available for adoption in India?
Yes, the 2017 amendment introduced maternity leave for adoptive mothers. A woman who adopts a child below the age of 3 months is entitled to 12 weeks of maternity leave from the date the child is handed over. Commissioning mothers (in surrogacy arrangements) also get 12 weeks of leave from the date the child is handed over. The same eligibility conditions of 80 days of work apply.
Can an employer terminate a woman during maternity leave?
No. Section 12 of the Maternity Benefit Act strictly prohibits the dismissal or discharge of a woman during maternity leave. An employer cannot change her conditions of service to her disadvantage during pregnancy or maternity leave. If an employer terminates a woman during this period, it is considered a criminal offence punishable with imprisonment and fine. The woman can also claim compensation through the labour court. What is the 80-day working requirement for maternity benefit?
To qualify for maternity benefit, a woman must have actually worked for at least 80 days in the 12 months immediately preceding the expected date of delivery. This includes days of paid leave and holidays on which she was not required to work. If the woman has not completed 80 days, she is not entitled to maternity benefit under the Act, though many companies still offer leave as part of their internal policy.
Is maternity benefit taxable in India?
Maternity benefit received by an employee is taxable under the Income Tax Act. It is treated as salary income and taxed at the applicable income tax slab rate. However, the standard deduction of ₹50,000 under Section 16 applies. The employer must deduct TDS on the maternity benefit amount as part of the regular salary. Some companies provide additional tax-saving benefits during maternity, so it is advisable to consult your HR or tax advisor.
Do contract employees get maternity leave?
Yes, contract employees are covered under the Maternity Benefit Act if they meet the eligibility criteria. They must have worked for at least 80 days in the 12 months before the expected delivery date, and the establishment must have 10 or more employees. The principal employer is responsible for ensuring the benefit is provided to contract workers. However, gig workers and freelancers working outside a formal employer-employee relationship are not covered under this Act. What is the medical bonus amount under the Maternity Benefit Act?
Under Section 8 of the Maternity Benefit Act, a woman is entitled to a medical bonus of ₹3,500 if no pre-natal and post-natal care is provided by the employer free of charge. This is a one-time payment made along with the maternity benefit. The government may increase this amount through notification. This bonus is in addition to the regular maternity benefit (salary) and is meant to cover medical expenses related to pregnancy and childbirth.
