What Is Non-GST Supply?
Every GST bill has a corner for the items the tax simply does not touch, and that corner is where non-GST supply lives.
Non-GST supply means goods or services on which GST is not leviable at all, because the law keeps them outside its scope in the first place. The CGST Act, 2017 calls this a “non-taxable supply” under Section 2(78): a supply that is not leviable to tax under the CGST Act or the IGST Act. Petrol, diesel and alcoholic liquor for human consumption are the ones an Indian business owner runs into most.
Which Goods Are Non-GST Supplies?
The list is short and fixed by law, not by a rate notification. Two categories cover it.
First, alcoholic liquor for human consumption, which the Constitution itself (Article 366(12A)) keeps out of GST so that states can tax it. Second, five petroleum products that Section 9(2) of the CGST Act has parked outside GST for now: petroleum crude, high-speed diesel, motor spirit (petrol), natural gas and aviation turbine fuel.

Because GST never applies, there is no input tax credit on a non-GST supply. A bar owner who buys liquor cannot claim credit on it, and cannot pass GST credit to the next buyer either.
Non-GST Supply vs Exempt Supply vs Nil-Rated
Here is where most owners slip, and it is worth slowing down. People assume petrol is “0% GST” the way fresh milk is, but the two are not the same thing at all.
Nil-rated and exempt goods sit inside the GST system on a zero or waived rate. Non-GST goods were never brought under GST to begin with. The practical fallout differs at return-filing time.

Note that zero-rated supply is a different animal again: exports and SEZ sales carry a 0% rate but do let you claim credit or a refund. Do not fold it into this group.
Non-GST Supply Example
Picture a bar-and-kitchen in Viman Nagar, Pune, closing a table’s bill on a Friday night in March 2026. The food and soft drinks fall under GST at 5%. The beer and spirits are non-GST supply, so no GST touches them; they carry state VAT under Maharashtra’s excise rules instead.

Why Non-GST Supply Matters for GST Returns
You still have to declare it. A non-GST supply is not charged GST, but the government wants the value on record, so table 3.1(e) of GSTR-3B carries a dedicated row for “non-GST outward supplies”. The matching figure also feeds the nil, exempt and non-GST table in GSTR-1.
