Tip Management in Restaurants: Meaning & How It Works

What Is Tip Management?

Tips look simple until a guest pays by card.

Tip management is how a restaurant collects tips, decides who shares in them, and gets that money into the hands of the staff who earned it. In India it matters most for card and UPI tips, because those settle into the restaurant’s own bank account before anyone can pass them on.

The Supreme Court settled this in ITC Ltd v CIT (2016), a case about banquet and restaurant tips. Reversing the Delhi High Court, it held that the person paying is the customer and not the employer, so the business is only a conduit holding that money in a fiduciary capacity. It is never the restaurant’s to keep.

Two tips, two very different paths Cash Guest pays Server nothing to administer Card Guest pays Bank account Server the restaurant holds it in the middle
Card tips are the ones that need managing, because they arrive in the company’s account first.

How a Tip Reaches the Server

How the guest pays decides how much work lands on you.

RouteWhat happensWho holds it
CashLeft on the table or handed overNobody, it goes straight across
CardAdded on the machine, settles with the billThe restaurant, until payout
UPIScanned to the outlet’s code, or the server’s ownDepends whose code it was

Across the outlets we work with, the tip that causes trouble is never the cash one. It is the card tip that settled three days ago and quietly stayed put, which is why the bill settlement process and the payout run need to be the same conversation.

A table that splits the bill across three cards can leave three separate tips behind, each needing the same treatment. Whatever your rule is, write it down and show it to the team before a shift, not after.

Difference Between a Tip and a Service Charge

Guests use the words interchangeably. Indian law does not.

AspectTipService charge
Decided byThe guest, after serviceThe restaurant, on the bill
On billNo, it sits outside the totalYes, it is a printed line
GSTNot charged on a voluntary tipCharged, as part of the bill value
PayoutBy whatever rule you setAt the establishment’s discretion

A tip is not part of the bill’s taxable value, so no GST rides on it, even when the card machine collects it alongside the payment. A service charge does, which is why guidelines issued by the Central Consumer Protection Authority on 4 July 2022 stopped restaurants adding one by default and made it voluntary. Confusing the two on a printed bill is how complaints start.

Tip Management Example

A 40-cover restaurant in Basavanagudi, Bengaluru pools card tips across a dinner shift and splits them by points.

RolePeoplePoints eachShare
Server32Rs.1,080 each
Host11Rs.540
Kitchen21Rs.540 each
Total69 pointsRs.4,860

Note: this is an invented example for illustration only. The outlet, the team size and every rupee figure are made up to show how a points split works.

Tip per point = pool total / total points

Nine points into Rs.4,860 gives Rs.540 a point, and the arithmetic is the easy half. The hard half is agreeing the points before service, and paying out on a date everyone knows. A tip calculator settles the guest side of the same question.

How Tips Are Taxed in India

This is where owners assume the worst and over-deduct.

  • No TDS on tips as salary. In ITC Ltd v CIT the Supreme Court held that tips are not salary, because they come from the guest rather than the employer, so section 192 does not apply to them.
  • The staff member still pays tax. The same ruling places tips under income from other sources in the employee’s hands, which is their return to file, not yours.
  • A voluntary tip carries no GST. It is not payment for anything the restaurant sold, unlike a service charge on the bill.

Because tips are not salary, they sit outside net salary and outside the payslip. Keep the payout record separate from wages so the two never get confused at audit, and take your accountant’s view before booking any of it in the P&L.

Close the Shift Knowing Who Earned What

Petpooja POSS does not split a tip pool for you, and no honest page should claim otherwise. What it does give you is the evidence the split rests on: reports covering your restaurant’s day-end sales, online orders, staff actions and inventory consumption, across 80+ business reports.

The split stops being an argument once the shift is on record rather than in somebody’s memory. That is the quiet part of running the best restaurant management software: fewer disputes at closing time.

The rule matters more than the software. Agree it in writing, using something like this staff shift schedule template, and keep it alongside the rest of your restaurant staff management.

Frequently Asked Questions

Can a restaurant keep part of the tips?

Legally it is uncomfortable ground, because the Supreme Court described the employer as holding tips in a fiduciary capacity for staff. If you hold anything back, agree it with the team in writing beforehand rather than explaining it after payday.

Is a tip the same as a service charge?

No. A tip is voluntary and decided by the guest after service, while a service charge is added by the restaurant to the bill and, since the CCPA guidelines of 4 July 2022, cannot be applied by default.

Do we deduct TDS on tips?

Not as salary. ITC Ltd v CIT settled that tips are not salary because they originate with the guest, so section 192 does not bite; the employee reports them as income from other sources.

How should a tip pool be split?

There is no legal formula, so pick one the team accepts and stick to it. Points by role, an equal share per shift, or hours worked are all common.

Do tips help retain staff?

They help, but they are not a substitute for pay. Predictable payouts matter more than large ones, and these strategies to retain restaurant staff go further than a good Saturday.
