IT Declaration
Meaning, Types & How It Works
4 min readAn IT declaration (income tax declaration) is a form a salaried employee submits to their employer, listing planned tax-saving investments and exemptions for the financial year. The employer uses it to calculate monthly TDS under Section 192 of the Income Tax Act, 1961. The prescribed format is Form 12BB (Rule 26C, Income Tax Rules, 1962), covering 80C, 80D, HRA, home loan interest, and the old vs new regime choice.
What Is an IT Declaration?
Skip it, and TDS gets deducted on your full gross salary under the default new regime with only the Rs.75,000 standard deduction.
What Sections Does an IT Declaration Cover?
Six deduction categories show up in most declarations (old regime only):
| Section | What It Covers | Annual Limit (FY 2025-26) |
|---|---|---|
| 80C | PPF, ELSS, LIC premium, EPF, tuition fees, home loan principal | Rs.1,50,000 |
| 80CCD(1B) | NPS (additional, beyond 80C) | Rs.50,000 |
| 80D | Health insurance premium (self, family, parents) | Rs.25,000 to Rs.1,00,000 depending on age |
| 10(13A) | HRA exemption | Least of three formula-based amounts |
| 24(b) | Home loan interest | Rs.2,00,000 (self-occupied) |
| 80E | Education loan interest | No upper limit, up to 8 years |
Under the new regime (default from FY 2023-24), most of these do not apply.
How Does the IT Declaration Process Work?
Timelines vary by employer, but the general pattern follows the financial year:
| When | What Happens |
|---|---|
| April | Employee submits provisional declaration: planned investments, rent, home loan, regime choice. No proof needed yet |
| April to December | Employer spreads TDS across monthly salary runs based on declared amounts |
| January to February | Proof submission window opens: rent agreements, 80C certificates, insurance receipts, home loan statements. Landlord’s PAN required if annual rent exceeds Rs.1,00,000 |
| February to March | Employer recalculates TDS based on actual proofs. Shortfalls recovered from remaining payslips |
IT Declaration Example
This is a hypothetical scenario for illustration only.
A payroll coordinator at a garment export firm in Whitefield, Bangalore. Annual CTC: Rs.7,20,000. Old regime, April 2026.
| Declared Investment | Section | Amount |
|---|---|---|
| PPF + ELSS + LIC premium | 80C | Rs.1,34,000 |
| Health insurance (self + parents) | 80D | Rs.38,000 |
| Rent (Rs.18,000/month) | 10(13A) | HRA exemption calculated separately |
Without this declaration, TDS is calculated assuming zero deductions beyond the standard Rs.75,000. With it, her monthly net salary goes up by roughly Rs.3,200 to Rs.3,800 depending on the HRA calculation. Use the free salary calculator or the CTC calculator to model your own numbers.
Why Does the IT Declaration Matter for Indian Businesses?
For employees, it is the difference between a bloated TDS cut and a higher take-home. For employers, a compliance obligation under Section 192. TDS short-deduction attracts interest at 1.5% per month under Section 201(1A).
At Petpooja, we have seen businesses in Jaipur and Lucknow scramble every February because employees submit proofs on the last day, forcing a rushed recalculation across 50+ payslips. The CTC salary structure template and this guide on payroll calculation help map salary structure components before the declaration window opens.
How Attendo (formerly Petpooja Payroll) Handles IT Declarations
Attendo lets employees submit their declaration and regime choice through the mobile app. TDS recalculates each month based on declared investments, and the proof submission window opens in January. Burgitos and Doolally use this across their outlets.
Frequently Asked Questions
What happens if I do not submit an IT declaration?
Your employer deducts TDS under the default new regime, factoring in only the Rs.75,000 standard deduction. No 80C, 80D, or HRA relief. You can claim the excess back by filing your ITR in July.
Can I revise my IT declaration mid-year?
Most employers allow one revision, typically around October. Across 30,000+ Attendo clients, companies that open a mid-year window see fewer February surprises.
Is an IT declaration the same as filing an income tax return?
No. The declaration is an internal document for your employer to adjust monthly TDS. An ITR is filed after the financial year ends and goes to the Income Tax Department.
Which tax regime should I pick in the declaration?
If your total deductions (80C, 80D, HRA, home loan interest) cross Rs.3,75,000 or so, the old regime probably saves more. Below that, new regime slab rates tend to win. Check with your CA before locking in.
Do I need to submit rent receipts with the declaration?
Not at the provisional stage. Receipts and landlord’s PAN (if annual rent exceeds Rs.1,00,000) are needed during proof submission in January or February.
What is Form 12BB?
The format prescribed under Rule 26C for declaring tax exemptions and deductions to your employer. Submitted at the start of the FY, updated with proofs before year-end. The employer uses it to issue Form 16 after March.
