HR Policy

Meaning, Types & How It Works in India

4 min read
Definition

An HR policy is a written document that tells everyone in the organisation how a specific workforce matter will be handled, and in India it is the first thing a labour court asks for when a dispute is filed. How much paid leave do people get? What is the notice period? What happens if someone skips work? It sits between the law (the floor) and the individual contract (one person).

What Is an HR Policy?

Most Indian SMEs run without written policies until something breaks. A leave encashment fight at a garment unit in Thane. A termination challenge in Chandigarh. A harassment complaint at a cafe chain in Vizag that had no POSH committee because nobody thought 14 employees was enough. If the policy does not exist, the employer’s version carries almost no weight in court.

What Are the Common Types of HR Policies?

A 15-person bakery in Kothrud, Pune does not need a work-from-home policy. A 200-employee plant in Udaipur probably skips the social media policy. But some are mandatory under Indian law, and others kick in once your headcount crosses a threshold.

Example list grouped by priority. Requirements vary by state.

How Does an HR Policy Actually Work?

Draft, approve, communicate, enforce, update. Five steps. Skip one and the whole thing falls apart.

A retail chain in Hebbal, Bangalore writes a rule: three unapproved absences trigger a warning letter. Good. But that rule has to reach every employee on day one (WhatsApp group, notice board, whatever), and it has to be enforced in October when someone actually hits three. Ignore the rule for six months and then fire someone on the seventh instance? A labour court will tear that apart.

We have seen this play out across 30,000+ Attendo clients. The policy sits in a Google Doc nobody touched since 2022, half the staff joined after it was circulated, and the payroll system runs on different leave rules. That mismatch is where disputes start.

Why Do HR Policies Matter for Indian Businesses?

Rs.11,400. That is roughly what a single earned leave dispute costs in legal fees before a hearing even starts, based on what labour consultants in Pune and Ahmedabad typically charge. A one-page leave policy would have prevented it.

Payroll accuracy is the other reason. Every leave deduction and overtime calculation sits on a policy rule. No written rule? The payroll team improvises. Two people in the same role, different leave balances. One notices in March during encashment. Questions start. The most common payroll error we see is not a bad formula but an accrual rule nobody put on paper.

How Attendo (formerly Petpooja Payroll) Supports HR Policy Enforcement

Attendo lets you configure leave types, accrual rates, attendance rules, and deduction logic in the system itself, so the policy becomes the engine behind every payslip, not a document gathering dust. Late-coming deductions, half-day thresholds, week-off patterns: configurable per location. A hospital group in Mysore with separate shift rules for nursing, admin, and housekeeping runs all three from one setup.

Frequently Asked Questions

Is a written HR policy legally required in India?

Some are, some are not. POSH Act mandates an anti-harassment policy at 10+ employees. Shops & Establishments Acts require documented leave rules. Dress code, social media, remote work? Optional. But they become valuable the moment a dispute reaches a labour officer.

How often should HR policies be updated?

Once a year at minimum, and after any law change. The Maternity Benefit amendment in 2017 caught many SMEs off guard. The new labour codes (still pending notification in most states as of May 2026) will be the next trigger.

Can an employer change HR policies without employee consent?

For non-core items (visitor rule, parking), yes. For anything touching pay, leave, or working hours, written communication and reasonable notice are needed. Unilateral changes to core terms can be challenged under the Industrial Disputes Act.

What is the difference between an HR policy and an employment contract?

Contract: one person. CTC, designation, notice period. Policy: everyone, or a defined group (all warehouse staff, managers above Grade C). Covers ground that 50 individual contracts cannot address one by one.

Do startups and small businesses need HR policies?

Short answer, yes. Even at 5 people. Write down the leave rules, attendance expectations, exit process. Doing it now while everyone agrees on what “casual leave” means is far easier than at 30 people when three managers have three interpretations.
